When Colorado cake artist Jack Phillips opened his cakeshop 24 years ago, he wanted to do more than just provide for his family and his employees. He wanted to serve his community, share his artistic talents, and honor God through his work every day.

He even named his business Masterpiece Cakeshop. The name was inspired at least in part by his favorite Bible verse, Ephesians 2:10, which says, “For we are God’s masterpiece. He has created us anew in Christ Jesus, so we can do the good things He planned for us long ago.”

As Jack says, “We don’t want God to be part of our lives on just Sundays. We want Him to be part of our lives every day.” 

That’s why Jack was shocked when not just his business, but his faith became the subject of vicious attacks and threats of government punishment when his conscience would not allow him to design a custom cake for a same-sex wedding. 

The government should not force anyone to create art that conflicts with their conscience. Yet that is exactly what the government did to Jack. And if the government has the power to tell you what to believe on the subject of marriage, it has that same power over all issues.  

That’s un-American. And terrifying.

Jack did not go looking for trouble …

But trouble found him in 2012, when two men came into Jack’s cakeshop requesting a wedding cake for their same-sex ceremony. In a brief exchange, Jack politely declined the request, saying simply that he could not design cakes to celebrate same-sex ceremonies. 

The men stormed out of the store. Shortly afterwards, Jack started to receive phone calls from people threatening him because of his decision.

Jack could handle the obscene phone calls. In fact, he chose to pray for the angry people who threatened and harassed him. 

But when he opened a letter from the Colorado Civil Rights Commission informing him he was being charged with sexual orientation discrimination in violation of a Colorado law, Jack knew he needed help.

We’ve battled all the way to the U.S. Supreme Court

Alliance Defending Freedom and ADF Allied Attorneys came to Jack’s defense, and not a moment too soon. Even after explaining to the commission that Jack will serve all people, including the same-sex couple who came into his store, but that he can’t design cakes to celebrate events that conflict with his faith, an administrative law judge ruled against Jack. 

The judge said that Jack’s artistic expression – in the form of creating one-of-a-kind wedding cakes — is not speech that is protected under the First Amendment.

The commission ordered Jack and his staff not only to create cakes for same-sex wedding celebrations, but also to implement new policies to comply with the judge’s order, and file quarterly “compliance” reports for two years to show that he had eliminated his religious beliefs from his business.

Jack was even ordered to provide training for his employees to teach them that his religious beliefs violate state law, and that he cannot draw upon his beliefs in deciding how to run his business.

In October 2015, ADF appealed his case to the Colorado Supreme Court, emphasizing the importance of his case for religious freedom and free speech rights. The state high court, however, declined to hear Jack’s case.

But on June 26, 2017, the United States Supreme Court agreed to hear Jack’s case. The hearing will likely be this fall, and the decision will be one of the most important of our lifetime. The outcome will have lasting implications for many other ADF clients who are fighting for their religious freedom.

Our hope is that you would agree that the Supreme Court must reverse the government’s punishment of Jack. Not only because it’s the right thing to do, but because attacks on his religious freedom are attacks on your religious freedom, and on the religious freedom of generations to come, including your children and grandchildren.

Upon learning that the Supreme Court would hear Jack’s case, left-wing advocates reacted strongly to the Court’s decision. One went so far as to say that “LGBTQ advocates may be on the verge of a constitutional catastrophe.” They want to coerce people with differing views. Anyone who refuses to join in their celebrations of same-sex marriage will be crushed.
