Allied Attorney Updates

April 2012

Congratulations to Allied Attorneys Steven O’Ban, Kristen Waggoner, Jack Edwards, Stephen Casey, Ruth Ross, Rebecca Messall, Samuel Harms, Joshua Hershberger, and John Garza as well as new Honor Corps member Mark Matney for their recent accomplishments and successes listed below.   • Steven O’Ban and Kristen Waggoner (Ellis, Li & McKinstry, PLLC). Seattle, Washington Allied Attorneys Steven O’Ban and Kristen Waggoner, co-counseling with the Becket Fund for Religious Liberty and with further support from several other Allied Organizations and Attorneys, successfully protected Christian pharmacists from being forced by the State Board of Pharmacy to dispense “emergency contraceptives” against their religious belief that such drugs terminated the lives of human beings.  The opinion was issued by the U.S. District Court for the Western District of Washington in the case of Stormans v. Selecky.
  • Jack Edwards (Edwards Law Office, P.C.). Etna, Wyoming Allied Attorney Jack Edwards prevailed upon the Wyoming Supreme Court to strike down as unconstitutional a District Court ex parte TRO that enjoined Operation Save America from assembling ”without a permit or holding posters/signs or materials of any graphic nature (e.g. aborted fetus pictures)” within two blocks of a Boy Scouts of America Expo event.
  • Stephen Casey (Casey Law Office, P.C.). Austin, Texas Allied Attorney Stephen Casey successfully defended a Christian ministry and two associated ministers sued by a prominent anti-religious advocate.  The district judge granted summary judgment in the defendants’ favor, holding that prayers posted on a personal website were protected free speech and did not constitute a conspiracy to harm the activist.
  • Ruth Ross (Christian Legal Fellowship). London, Ontario Allied Attorney Ruth Ross of the Christian Legal Fellowship of Canada played a vital role in successfully defending against attacks on Ontario’s laws regarding prostitution.  In Bedford v. A.G. the Court of Appeal for Ontario upheld the constitutionality of statutes prohibiting  “communicating for the purpose of prostitution in public” and “living on the avails of prostitution” in circumstances of exploitation.
  • Rebecca Messall (Hackstaff Law Group, LLC). Denver, Colorado Allied Attorney Rebecca Messall, in conjunction with the Thomas More Society, successfully got the U.S. Dept. of Justice to dismiss all FACE charges against a pro-life advocate after the U.S. District Court ruled that the A.G. had failed to prove that the government was reasonably likely to prevail at trial.
  • Samuel Harms (Harms Law Firm, P.A.). Greenville, South Carolina Allied Attorney Samuel Harms successfully prevailed upon the South Carolina Supreme Court to strike down as unconstitutional a city ordinance making it a crime to “humiliate, insult, or scare any person.”   Sam’s clients – two street preachers - had been prosecuted under the ordinance for publically preaching against homosexuality and distributing literature.
  • Joshua Hershberger (Castor & Hershberger, P.C.). Madison, Indiana Allied Attorney Joshua Hershberger successfully procured from City of Indianapolis an official letter stating that non-commercial religious speech, including signs with religious messages such as “Jesus Saves,” are not subject to the City’s limited duration commercial licensing requirements.
  • John Garza (Garza, Regan & Associates, P.C.). Rockville, Maryland Allied Attorney John Garza spoke on free speech at a National Lawyers Guild conference.

    Allied Attorney Honor Corps. This month Mark Matney was inducted into the Allied Attorney Honor Corps. Allied Attorneys become Honor Corps members when they have reported at least 450 hours of qualifying pro bono work.
